Terms of Use
These terms and conditions of use (hereinafter referred to as the "Terms and Conditions") shall be governed by and construed in accordance with the laws of Japan.
This Terms of Use ("Terms of Use") applies to the services provided by the Takenaka Carpentery Tools Museum ("TCTM") on this website ("Service"). This document sets forth the terms and conditions of use of the services provided by the TCTM on this website.
Registered users ("User(s)") are requested to use the Service in accordance with these Terms of Use.
Article 1 (Application)
These Terms of Use shall apply to all relationships between the User and TCTM concerning the use of the Service.
In addition to these Terms of Use, the Company may establish various rules and regulations regarding the use of the Service (hereinafter referred to as "Individual Regulations").
In addition to the Terms of Use, the Company may also establish rules for the use of the Service (hereinafter referred to as "Individual Rules").
Regardless of the name by which these Individual Regulations are called, they shall constitute a part of this Agreement.
In the event of any conflict between the provisions of these Terms and Conditions and the individual provisions of the preceding Article, the provisions of the individual provisions shall take precedence unless otherwise specified in the individual provisions.
Article 2 (Registration)
Registration for use of the Service shall be completed when a prospective user agrees to these Terms of Use and applies for registration for use of the Service in a manner prescribed by TCTM, and when TCTM approves such application.
TCTM may not approve an application for registration if it determines that the applicant has any of the following reasons, and shall not be obligated to disclose the reasons for such denial.TCTM shall not be obliged to disclose any reason for such refusal.
- When false information is reported in the application for user registration
- When an application is submitted by a person who has violated these Terms of Use
- In addition, the Museum deems the registration of use to be inappropriate.
Article 3 (Management of User ID and Password)
The User shall properly manage his/her user ID and password for the Service at his/her own responsibility.
You may not, under any circumstances, transfer or lend your user ID and password to a third party, or share them with a third party. TCTM considers the use of the service to be by the user who has registered the user ID.
TCTM shall not be liable for any damage caused by the use of a user ID and password by a third party, except in the case of willful misconduct or gross negligence on the part of TCTM.
Article 4 (Usage Fees and Payment Method)
As compensation for the paid portion of the Service, the User shall pay the usage fee separately determined by TCTM and displayed on the Website, by the method designated by TCTM.
Article 5 (Prohibited Matters)

- Any act that violates laws and ordinances or public order and morals.
- Actions related to criminal acts.
- Infringement of copyrights, trademarks, or other intellectual property rights contained in the Service, such as the contents of the Service.
- Acts that destroy or interfere with the functionality of the Museum, other users, or third parties' servers or networks.
- Commercial use of information obtained through this service.
- Actions that may interfere with the operation of TCTM's services.
- Any unauthorized access or attempt to gain unauthorized access.
- Actions that collect or accumulate personal information about other users.
- Any act that uses the Services for any unauthorized purpose.
- Actions that cause disadvantage, damage, or discomfort to other users of this service or other third parties.
- Impersonating another user.
- Actions to advertise, advertise, solicit, or conduct business on the Service that are not authorized by TCYM.
- Actions for the purpose of meeting people of the opposite sex whom you have not met.
- Actions that directly or indirectly provide benefits to antisocial forces in relation to TCYM's services.
- Other acts that TCTM deems inappropriate.
Article 6 (Suspension of the Service, etc.)
TCTM may suspend or discontinue the Service, in whole or in part, without prior notice to the User, for any of the following reasons.
- Maintenance, inspection, or updating of computer systems related to the Service.
- In the event that provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
- When computers or communication lines are down due to an accident.
- When TCTM deems it difficult to provide this service.
- TCTM shall not be liable for any loss or damage incurred by the user or any third party due to the suspension or interruption of this service.
Article 7 (Restriction of Use and Cancellation of Registration)
TCTM may, without prior notice, restrict a user's use of all or part of the Service or terminate the user's registration if the user.
- The user has violated any of the provisions of this Agreement.
- When it is found that there is a false fact in the registration information.
- In the event of default in payment of fees or other obligations.
- When there is no response from TCTM for a certain period of time.
- When there has been no use of the Service for a certain period of time since the last use of the Service.
- TCTM deems the use of this service to be inappropriate.
TCTM is not responsible for any damage caused to the user as a result of any action taken by the Museum in accordance with this Article.
Article 8 (Withdrawal from Membership)
The User may withdraw from the Service by following the withdrawal procedure specified by TCTM.
Article 9 (Disclaimer of Warranty and Disclaimer of Liability)
TCTM makes no warranty, express or implied, that the Services will be free from defects in fact or law. (including any defects, errors or bugs, or infringements of rights with respect to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc.)
TCTM shall not be liable for any and all damages incurred by the user arising from the Service, except in cases of intentional or gross negligence on the part of TCTM. However, this disclaimer does not apply when the contract between TCTM and the user regarding this service constitutes a consumer contract as defined in the Consumer Contract Act. (Including these Terms and Conditions)
Even in the case of the proviso of the preceding paragraph, TCTM shall not be liable for any damage arising out of special circumstances among damages caused to the user due to default of obligation by TCTM's negligence (excluding gross negligence) or tortious act. (This includes cases where TCTM or the user foresaw or could have foreseen the occurrence of the damage.)
In addition, TCTM's liability for damages caused by default or tort due to TCTM's negligence (excluding gross negligence) shall be limited to the amount of the usage fees paid by the user for the service that caused the damages.
TCTM is not responsible for any transaction, communication, or dispute between a user and another user or a third party in connection with the service.
Article 10 (Change of Service Contents, etc.)
TCTM may change, add, or discontinue the Service with prior notice to the User, and the User agrees to such changes, additions, or discontinuation.
Article 11 (Modification of Terms of Use)
The Museum reserves the right to modify the Terms of Use without requiring the individual consent of the User in the following cases
- The modification of the Terms of Use is in the general interest of the User.
- When the modification of the Terms of Use is not contrary to the purpose of this Service Agreement and is reasonable in light of the necessity of the modification, reasonableness of the modified contents, and other circumstances pertaining to the modification.
TCTM will notify the User in advance of any modification of the Terms of Use in accordance with the preceding paragraph, the contents of the modified Terms of Use, and the effective date of the modification.
Article 12 (Handling of Personal Information)
TCTM handles personal information obtained through the use of this service appropriately in accordance with TCTM's "Privacy Policy".
Article 13 (Notification or Communication)
Notices or communications between a user and TCTM shall be made in the manner prescribed by TCTM, and unless a user notifies TCTM of a change according to a method separately prescribed by TCTM, TCTM shall assume that the currently registered contact address is valid and shall send notices or communications to that address. The notification or contact will be deemed to have reached the user at the time it is sent.
Article 14 (Prohibition of Assignment of Rights and Obligations)
The User may not assign its position in the Usage Agreement or its rights or obligations under this Agreement to any third party or offer them as security without TCTM's prior written consent.
Article 15 (Governing Law and Jurisdiction)
These Terms of Use shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
