Terms of Use

These Terms of Use (hereinafter referred to as "these Terms") establish the conditions for the use of the self-photo studio "Kanazawa Tsukimiru Omoideto" (hereinafter referred to as "the Service") operated by our company. These Terms apply to customers (hereinafter referred to as "Customers") intending to use, using, or having used the Service, and we will provide the Service to them in accordance with these Terms.

Article 1
1. These Terms apply to all relationships related to the use of the Service between Customers and our company.
2. Our company may establish rules (hereinafter referred to as "Rules") in addition to these Terms for the Service. Regardless of the name, Rules are considered part of these Terms.
3. In the event of a conflict between the provisions of these Terms and the Rules of the previous article, unless otherwise specified, the Rules shall take precedence.

Article 2
1. In the Service, Customers may make reservations or applications by agreeing to these Terms and receiving approval from our company through the method specified by us.
2. Our company may refuse approval of usage in cases where Customers are judged to have any of the following reasons, and we are not obligated to disclose the reasons for such refusal:
1. Providing false information when applying for reservations.
2. Previous violations of these Terms.
3. Other instances where our company deems the usage to be unsuitable.

Article 3
1. Customers are responsible for properly managing their reservation numbers and passwords associated with the Service.
2. Under no circumstances may Customers transfer, lend, or share their reservation numbers and passwords with third parties.
3. Our company assumes no responsibility for damages arising from the use of a customer's ID and password by a third party unless intentional or gross negligence is on our part.

Article 4
1. Customers shall pay the usage fee set by our company as the consideration for the Service on the day of using the Service through the method designated by our company.
2. If a customer who has received the Service refuses to pay the usage fee, we will report it to appropriate authorities such as the police.
3. In cases where a user has caused damage to our company due to violation of these Terms or through fraudulent or illegal actions, our company can demand compensation for the damages from the user.

Article 5
Customers shall not engage in the following acts when using the Service:
1. Acts that violate laws or public morals.
2. Acts related to criminal activities.
3. Acts that obstruct other Customers.
4. Acts of collecting or accumulating personal information of other Customers.
5. Acts that cause disadvantages, damages, or discomfort to other Customers or third parties in relation to the Service.
6. Impersonation of other Customers.
7. Acts that infringe on copyrights, trademark rights, or other intellectual property rights included in the content of the Service.
8. Commercial use of information obtained through the Service.
9. Acts that may hinder the operation of our services.
10. Unauthorized access to reservation forms, our company's website (hereinafter referred to as "HP"), or social network services (hereinafter referred to as "SNS"), or attempting to do so.
11. Unauthorized advertising, promotion, solicitation, or business activities on the Service without our company's permission.
12. Acts directly or indirectly benefiting antisocial forces in relation to our services.
13. Other acts deemed inappropriate by our company.

Article 6
Our company may suspend or interrupt the provision of all or part of the Service without prior notice to Customers if any of the following circumstances are determined:
1. Maintenance or updating of systems or equipment (hereinafter referred to as "Equipment") related to the Service.
2. Natural disasters such as earthquakes, lightning, fires, power outages, or other force majeure events make it difficult to provide the Service.
3. Computers, communication lines, equipment, etc. are stopped due to accidents.
4. In other cases where our company deems it difficult to provide the Service.

Article 7
Our company may, without prior notice, restrict or suspend all or part of the use of the Service for Customers if they fall under any of the following:
1. Violation of any provision of these Terms.
2. Discovery of false information in the reservation registration details.
3. Exceeding the reserved or scheduled usage time or failure to visit or use after reservation.
4. Other instances where our company deems the usage to be inappropriate.

Article 8
1. Our company explicitly or implicitly does not guarantee the absence of defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for specific purposes, security, etc.) in the Service, either in fact or in law.
2. Our company shall not be liable for any damages incurred by Customers as a result of using the Service. However, if the contract between our company and Customers (including these Terms) regarding the Service falls under the Consumer Contract Act and becomes a consumer contract, this exemption clause will not apply.

In cases stipulated in the preceding paragraph, our company shall not be liable for damages arising from the customer's special circumstances due to our negligence (excluding gross negligence). Furthermore, compensation for damages caused by our company's negligence (excluding gross negligence) or illegal acts shall be limited to the usage fee for the Service that the customer incurred for such damages.
4. Our company shall not be liable for any transactions, communications, or disputes arising between Customers and other Customers or third parties regarding the Service.

Article 9
Our company may change or discontinue the content of the Service without notifying Customers, and shall not be liable for any damages caused to Customers as a result.

Article 10
Our company may change these Terms at any time without notifying Customers. However, if a customer starts using the Service after the change, the customer will be deemed to have agreed to the changed terms.

Article 11
Our company will handle personal information acquired through the use of the Service in accordance with our "Personal Information Protection Policy".

Article 12
Communication between Customers and our company shall be carried out through methods specified by our company. Unless prior notification, our company will consider the contact information registered at the time of reservation as valid for notifying or communicating with the customer, and these shall be considered as reaching the customer at the time of transmission.

Article 13
Customers shall not transfer their status under the usage agreement or rights or obligations based on these Terms to third parties or provide them as collateral without the prior consent of our company.

Article 14
The interpretation of these Terms shall be governed by Japanese law.
